New York Federal Violent Crime Defense AttorneysFederal Violent CrimesIn 1994 the Violent Crime Control and Law Enforcement Act reshaped the face of federal violent crimes law. In addition to a ban on the sale or manufacture of assault style weapons, the act also introduced new classifications for violent crime and extended the federal government’s ability to punish gang members and allowed the prosecution of juveniles as adults in some serious violent crimes. Although portions of this act have expired or been found unconstitutional, much of its legal framework remains in force. For those facing a violent crimes charge in New York, they should note that Title VI of the Federal Violent Crimes Act greatly expanded the types of violent crimes that are eligible for punishment by the death penalty, including drive-by shootings, the use of weapons of mass destruction and terrorism. These federal capital crimes are in addition to crimes that allow the death penalty as punishment, such as murder for hire. Also of note in the Violent Crime Control and Law Enforcement Act is the three strikes provision, which calls for mandatory life imprisonment for persons convicted of three prior federal violent crimes offenses. The 1994 act paved the way for individual states to follow with three strikes legislation of their own. Federal violent crimes laws are intended to protect society at large from dangerous acts. However, institutions that uphold public safety must act within the law. Given the seriousness of the legal and social consequences arising from a federal violent crimes charge, to accept anything less than full accountability, would be detrimental to the safety of the democracy.
